Artikel 1    Definities
In deze algemene voorwaarden wordt verstaan onder:

‘Passagier’
De natuurlijke persoon die een Toegangsbewijs voor het Evenement bestelt en / of het Evenement bezoekt;

‘Evenement’
Een door Erik Broeder en Jordy Vos georganiseerd evenement, dat onderdeel zal zijn van de Pride 2026 op de Amsterdamse grachten. De botenparade zal plaatsvinden op 1 augustus 2026. De ‘THE KISSING COUPLE’ zal meevaren in de parade met bootnummer # (wordt later bekend gemaakt).

‘Organisator’
Erik Broeder en Jordy Vos zijn de organisators van de ‘THE KISSING COUPLE’ ; een particulier initiatief.

‘Overmacht’
Een tekortkoming die niet aan Organisator kan worden toegerekend, omdat deze niet is te wijten aan haar schuld en noch krachtens de wet, rechtshandeling of in het verkeer geldende opvattingen voor haar rekening komt, waaronder: Annulering van de Pride, slechte weersomstandigheden, epidemieën, stakingen, brand, instorting, van overheidswege opgelegde voorschriften, oorlogsomstandigheden, terroristische dreiging, terroristische aanslagen, et cetera;

‘Toegangsbewijs’
Een door de organisator aan de Passagier geleverd digitale bevestiging bij de aankoop van het e-ticket, dat recht geeft op toegang tot het Evenement.

Artikel 2    Toegangsbewijs
2.1 Het gekochte toegangsbewijs is pas geldig na bevestiging vanuit de organisatie.
2.2 Het toegangsbewijs is niet aan derden overdraagbaar. Verkoop van het ticket is niet toegestaan.
2.3 Ieder ticket is verbonden aan de keuze van een specifiek dier. De outfit van de bezoeker dient hiermee overeen te komen. Toegang wordt geweigerd wanneer niet aan deze eis is voldaan.

Artikel 3    Gedragsregels
3.1 Op de boot wordt lunch, drank en snacks geregeld. Het is niet toegestaan eigen drank mee te nemen.
3.2 Het gebruik van drugs is niet toegestaan. Wanneer dit wordt geconstateerd wordt hier een melding van gedaan bij de politie en zal de desbetreffende persoon worden verwijderd van de boot.
3.3 Op de boot zal een toilet aanwezig zijn. Het is niet toegestaan ergens anders dan in het toilet te plassen.
3.4 Op de boot zullen afvalcontainers staan. Het is niet toegestaan afval op de boot of in de gracht te gooien.
3.5 Het is niet toegestaan voorwerpen naar het publiek te gooien.
3.6 Boetes die worden opgelegd vanuit de gemeente bij onbehoorlijk gedrag worden aan de desbetreffende passagiers doorberekend.
3.7 Tijdens de botenparade mogen Passagiers zich alleen op de boot ‘THE KISSING COUPLE’ begeven. Het is niet toegestaan zich te verplaatsen naar de duw- en trekboten. Schade die hieruit ontstaat zal de rederij doorberekenen aan de desbetreffende passagier(s).

Artikel 4    Annulering en overmacht
4.1 Annulering door passagier

Tot en met 31 mei kan de passagier annuleren en zal de organisatie 75% van de kosten voor het ticket binnen 10 werkdagen restitueren.
Tot en met 30 juni kan de passagier annuleren en zal de organisatie 50% van de kosten voor het ticket binnen 10 werkdagen restitueren.
Tot en met 15 juli kan de passagier annuleren en zal de organisatie 25% van de kosten voor het ticket binnen 10 werkdagen restitueren.
Na 15 juli kan er niet meer worden geannuleerd.

4.2 Annulering door de organisatie
Bij annulering van het evenement door de organisatie zullen alle ticket in zijn geheel worden gerestitueerd m.u.v. de reeds gemaakte en niet te verhalen kosten.

4.3 Annulering door Pride Amsterdam
Mocht de Pride van Amsterdam 2026 in zijn geheel worden geannuleerd dan zal de organisatie de tickets restitueren m.u.v. de reeds gemaakte en niet te verhalen kosten.

Artikel 5 Aansprakelijkheid
De organisatie van de ‘THE KISSING COUPLE’ verlegd de aansprakelijkheid in de ruimste zin naar de passagier. De organisatie is niet verantwoordelijk voor o.a. (maar niet gelimiteerd tot):

Schade, breuk, verlies en diefstal aan meegebrachte voorwerpen/ eigendommen.
Ziekte, letsel of de dood van een passagier.

Artikel 6 Verwerking persoonsgegevens
De organisatie van de ‘THE KISSING COUPLE’ zal de verzamelde persoonsgegevens van de passagiers na 3 september 2026. Omwille van de organisatie zal er een whatsappgroep worden gemaakt waarin elke passagier wordt toegevoegd. Bij het aankopen van een ticket is gaat de passagier hiermee akkoord.

Article 1 Definitions
In these terms and conditions, the following definitions apply:

‘Passenger’
The natural person who orders an Admission Ticket for the Event and/or attends the Event.

‘Event’
An event organized by Erik Broeder and Jordy Vos, which is part of Pride 2026 on the Amsterdam canals. The boat parade will take place on August 1, 2026. ‘THE KISSING COUPLE’ will participate in the parade with boat number # (to be announced later).

‘Organizer’
Erik Broeder and Jordy Vos are the organizers of ‘THE KISSING COUPLE’; a private initiative.

‘Force Majeure’
A failure that cannot be attributed to the Organizer, because it is not due to its fault and is not accountable by law, legal act, or generally accepted practice, including: Cancellation of Pride, bad weather conditions, epidemics, strikes, fire, collapse, government-imposed regulations, war conditions, terrorist threats, terrorist attacks, etc.

‘Admission Ticket’
A digital confirmation delivered by the Organizer to the Passenger upon purchase of the e-ticket, granting access to the Event.

Article 2 Admission Ticket
2.1 The purchased admission ticket is only valid after confirmation from the organization.
2.2 The admission ticket is non-transferable to third parties. Resale of the ticket is not allowed.
2.3 Each ticket is linked to the choice of a specific animal. The visitor’s outfit must correspond accordingly. Access will be denied if this requirement is not met.

Article 3 Code of Conduct
3.1 Lunch, drinks, and snacks will be provided on the boat. Bringing your own drinks is not allowed.
3.2 The use of drugs is not permitted. If this is detected, the police will be notified and the individual will be removed from the boat.
3.3 A toilet will be present on the boat. It is not allowed to urinate anywhere other than in the toilet.
3.4 Trash bins will be available on the boat. It is not permitted to throw waste on the boat or into the canal.
3.5 Throwing objects at the audience is not allowed.
3.6 Fines imposed by the municipality for inappropriate behavior will be passed on to the respective passengers.
3.7 During the boat parade, passengers may only stay on the ‘THE KISSING COUPLE’ boat. It is not allowed to move to the push or pull boats. Any resulting damage will be charged by the shipping company to the respective passenger(s).

Article 4 Cancellation and Force Majeure

4.1 Cancellation by the Passenger
Cancellations up to and including May 31: 75% of the ticket cost will be refunded within 10 working days.
Cancellations up to and including June 30: 50% of the ticket cost will be refunded within 10 working days.
Cancellations up to and including July 15: 25% of the ticket cost will be refunded within 10 working days.
No cancellations will be accepted after July 15.

4.2 Cancellation by the Organizer
If the event is canceled by the organizer, all tickets will be fully refunded, except for incurred and non-recoverable costs.

4.3 Cancellation by Pride Amsterdam
If Pride Amsterdam 2026 is canceled entirely, the organizer will refund the tickets, except for incurred and non-recoverable costs.

Article 5 Liability
The organization of ‘THE KISSING COUPLE’ shifts liability to the passenger to the broadest extent. The organization is not responsible for, including but not limited to:
• Damage, breakage, loss, or theft of brought items/belongings.
• Illness, injury, or death of a passenger.

Article 6 Processing of Personal Data
The organization of ‘THE KISSING COUPLE’ will delete the collected personal data of passengers after September 3, 2026. For organizational purposes, a WhatsApp group will be created in which each passenger will be added.
